IMPORTANT UPDATE ON THE STATE OF THE ATASCOCITA GOLF COURSE PROPERTY
Dear Atascocita Golf Course Property Owners,
This summer, everything seemed to be going well:
Kim Spurlock won the lawsuit and the court upheld the Deed Restrictions on the golf course (for golf course use only).
The Point Course was put back into operation and people are playing on all three courses once again.
BUT: Brunson Development and Timeout (owners of the golf course) are undeterred in their quest. You will be receiving a letter soon from Brunson Development.
It will ask all property owners to SIGN AN "AMENDMENT TO SPECIAL WARRANTY DEED" allowing Brunson to purchase 7.1 acres along FM 1960 and develop it for townhouses.
It will explain that 75% of homeowners must sign so that this sale can take place (this is what the deed restrictions stipulate).
It will say that without the sale of this property, the golf course cannot afford to remain in operation.
It will threaten to close all three golf courses and discontinue maintenance of the courses if this demand is not met.
It will "promise" that if their demands are met, they will develop the 7.1 acres and we will all live happily ever after.
WHAT SIGNING WILL MEAN FOR US ALL:
It will LEGALLY NEGATE the deed restrictions on all golf course properties. Timeout will be free to sell not only the 7.1 acres but ALL GOLF COURSE PROPERTIES FOR WHATEVER PURPOSE THE DEVELOPER WISHES.
ASK YOURSELVES
Do you believe that Timeout and Brunson will be content with developing 7.1 acres?
Do you believe they will uphold their "promise" to respect the Deed Restrictions on the rest of the three courses going forward?
Do you believe they will close all three courses and put fences up if you do not sign?
Is Brunson Development a group that you trust?
The repercussions of signing the Amendment to the Special Warranty Deed will have far-reaching consequences for us all.
On the value of our property.
On our quality of life.
Those of us sending this letter, the "Save the A" group,
WILL NOT SIGN THE AGREEMENT
TO THE SPECIAL WARRANTY DEED
and we encourage you to think VERY CAREFULLY about this matter when you receive the Brunson proposal.
